The Office of the Ombudsman has ordered the suspension of mayor Necitas Cubrado of Pilar, Bohol, for one month and one day after she was found guilty of Simple Misconduct.

Investigation disclosed that Cubrado approved the contract of services of Marvina Renegado and Rosabel Quimsom for the period of 04 January 2016 until 30 June 2016.  The job order contracts were made by respondent without the required prior approval and authority of the Sangguniang Bayan (SB) in violation of the Local Government Code.

In its 07 September 2017 Decision, the Ombudsman stated that “the exercise of such power, when entering into contracts of services, is qualified by Section 22 (c) of the Local Government Code. Section 444 (b)(1)(vi) moreover, provides that the authority of the mayor to represent the municipality through contracts must be with the prior authority of the sanggunian.  Thus, respondent, needed prior authority from the SB to enter into the subject contracts of services with Quimson and Renegado.”

Misconduct is the transgression of some established and definite rule of action, more particularly, unlawful behavior or gross negligence by a public officer. ###
