Arfran Quiñones, former mayor of Lupon, Davao Oriental is facing 10 counts of Malversation of public property and one count of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019) before the Sandiganbayan.  Based on the charge sheet, Quiñones was found to have misappropriated government properties valued at P446,425.77.   The Office of the Ombudsman found that after the end of his term in 2007, government properties under his custody remain unaccounted for.   These consist of technical and scientific equipment, laptop, IT equipment and software, office supplies, mobile phone, and projector.

Under section 3(e) of R.A. No. 3019, public officials are prohibited from causing any undue injury to any party, or giving any private party any unwarranted benefits, advantage or preference in the discharge of his official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence.  Meanwhile, Malversation is committed by a public officer who, by reason of the duties of his office, is accountable for public funds or property, shall appropriate the same or shall take or misappropriate or shall consent, through abandonment or negligence, shall permit any other person to take such public funds, or property ###
